Employees do not retain any ownership rights to data created using the App in the course of their employment.

1.7 Data Retention

1.9 Changes to This Privacy Policy

We reserve the right to modify this Privacy Policy at any time. 2. Terms of Service

2.1 Acceptance of Terms

By accessing or using the DeluxeField App, you ("Employee" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App. Your use of the App constitutes acceptance of these Terms and any future modifications.

2.2 License Grant

Deluxe Waterproofing & Caulking, Inc. grants authorized employees a limited, non-exclusive, non-transferable, revocable license to use the DeluxeField App solely for internal business purposes in connection with their employment duties. This license may be terminated at any time, with or without cause, at the Company's sole discretion.

2.3 Authorized Use Only

The App is intended for use exclusively by current employees of Deluxe Waterproofing & Caulking, Inc. who have been authorized by management. Access is typically granted to field personnel, project managers, and other staff who require the App to perform their job functions. Unauthorized access, use, or distribution of login credentials is strictly prohibited.

2.4 Employee Responsibilities and Acceptable Use

As a user of the App, you agree to:

• Provide accurate, truthful, and complete information when using the App
• Record all work time, breaks, and activities honestly and accurately
• Maintain the confidentiality and security of your login credentials
• Use the App only for legitimate business purposes related to your employment
• Comply with all Company policies, procedures, and applicable laws
• Promptly report any suspected security breaches, unauthorized access, or technical issues
• Allow location tracking when required for time tracking and job site verification
• Take and upload photos and documentation as directed by management or company policy

2.5 Prohibited Conduct

Employees are expressly prohibited from:

• Falsifying time entries, reports, or any other data submitted through the App
• Sharing login credentials with other individuals, including other employees
• Attempting to disable, circumvent, or manipulate location tracking or other App features
• Using the App for personal business or non-work-related activities
• Accessing, copying, or distributing Company data without authorization
• Reverse engineering, decompiling, or attempting to extract source code from the App
• Introducing malware, viruses, or other harmful code to the App or Company systems
• Using the App in any manner that could damage, disable, or impair Company systems

2.6 Monitoring and Enforcement

The Company reserves the right to monitor all use of the App, including but not limited to reviewing time entries, location data, photos, reports, and other submitted information. Any suspected misuse, fraud, or violation of these Terms may result in:

• Immediate suspension or termination of App access
• Disciplinary action, up to and including termination of employment
• Legal action to recover damages or pursue criminal charges where appropriate

2.7 Company Rights and Modifications

Deluxe Waterproofing & Caulking, Inc. reserves the right to:

• Modify, suspend, or discontinue the App or any features at any time without notice
• Update these Terms of Service at any time, with changes becoming effective upon posting
• Revoke access to the App for any employee at any time, for any reason
• Monitor, access, and review all data created or submitted through the App
• Set usage requirements, implement new features, and establish operational guidelines

2.8 No Expectation of Privacy

Employees acknowledge and agree that they have no expectation of privacy with respect to any data, communications, or activities conducted through or recorded by the App. All information is subject to review by the Company at any time for any lawful business purpose.

2.9 Termination of Access

Access to the App will typically be terminated upon the end of your employment with Deluxe Waterproofing & Caulking, Inc., whether through resignation, retirement, or termination. The Company may also suspend or terminate access at any time for violation of these Terms or for any other reason at its sole discretion.

2.10 Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE COMPANY DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. EMPLOYEES USE THE APP AT THEIR OWN RISK.

2.11 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DELUXE WATERPROOFING & CAULKING, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

2.12 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Broward County, Florida.
